Prohibits a parent's or caregiver's disability from being considered the sole factor in determining fitness as a foster parent, resource family member, or prospective adoptive parent.

Prevents disability from being the sole factor in judicial determinations regarding guardianship appointments, custody awards, visitation rights, or whether a family can provide a safe home.

Requires the Department of Human Services and courts to provide specific written findings stating the actual basis for any denial of petitions or appointments when a disabled person is involved.

Applies to evaluations under Hawaii Revised Statutes chapters 346 (child welfare), 560 (guardianship), 571 (family court custody/visitation), and 587A (child protective proceedings).

Effective upon approval and does not affect rights, duties, or proceedings that existed before the law takes effect.
