H.B. 704 Summary

• Prohibits manufacturers from importing for profit, selling, or offering for sale cosmetics in Hawaii if animal testing was conducted on the product or its ingredients on or after January 1, 2021.

• Establishes exemptions for animal tests required by federal or state regulatory authorities, tests conducted to comply with foreign regulatory requirements (if safety data not relied upon for Hawaii sales), tests on drugs regulated under the Federal Food, Drug, and Cosmetic Act, and tests conducted for non-cosmetic purposes (if safety data not relied upon for Hawaii sales).

• Allows prosecuting attorneys to review cosmetic manufacturers' testing data upon reasonable belief of a violation, with trade secret protections and protective orders required.

• Establishes penalties of $5,000 plus $1,000 for each day a violation continues, enforced by county prosecuting attorneys with fines paid to the county.

• Effective January 1, 2150.
