Full-service restaurants are prohibited from providing single-use plastic straws to consumers unless the consumer specifically requests one.

First and second violations result in a notice of violation issued by the director; subsequent violations incur a fine of $25 per day of violation, not to exceed $300 per calendar year.

"Full-service restaurant" is defined as an establishment where employees seat consumers, take orders after seating, deliver food and beverages directly to consumers, and deliver checks at the assigned eating area.

"Single-use plastic straw" is defined as a disposable tube made predominantly of plastic from petroleum or biologically-based polymers, excluding straws made from paper, pasta, wood, or bamboo.

The Act takes effect on July 1, 2100.
