H.B. 862 - Collective Bargaining Summary

• Amends Hawaii Revised Statutes Section 89-8(a) to allow exclusive representatives of public employees to deny grievance representation to employees who neither pay union dues nor dues equivalents and decline to pay reasonable representation costs.

• Maintains existing protections requiring exclusive representatives to represent all bargaining unit members without discrimination and without regard to union membership status, except for the grievance representation carve-out.

• Effective date set for January 1, 2050.
