Requests the Legislative Reference Bureau to conduct a study examining the necessity and effectiveness of Hawaii's Certificate of Need (CON) process under Chapter 323D, Hawaii Revised Statutes

Study should evaluate whether certain facilities, types of facilities, or services should be exempt from the CON approval requirements for healthcare facility construction, expansion, and major capital expenditures

Study should examine modifications made to CON processes in other states (14 states have dropped their programs entirely since the 1987 federal mandate repeal) that may be beneficial for Hawaii to implement

Addresses criticisms of Hawaii's CON program including creation of market barriers, restriction of competition, hampering of healthcare innovation, inconsistent administration, and failure to control healthcare costs

Requires the Legislative Reference Bureau to submit findings, recommendations, and proposed legislation to the Legislature no later than twenty days prior to the 2021 Regular Session convening
