HCR 50 Summary

• Counties are requested to notify potential buyers at real property tax sales of the potential lack of title insurance, which may prevent future sale or mortgaging of those properties.

• A working group is to be convened by the President of the Senate and Speaker of the House to review problems related to potential lack of title insurance.

• The working group shall comprise chairs or designees of the Senate Committee on Commerce, Consumer Protection, and Health; Senate Committee on Judiciary; House Committee on Consumer Protection and Commerce; House Committee on Judiciary; and one member of the Hawaii State Bar Association section on collection law or real property and financial services.

• The working group is requested to report findings and recommendations, including any proposed legislation, to the Legislature at least 20 days prior to the Regular Session of 2021.

• Certified copies of the resolution shall be transmitted to the mayor of each county and the President of the Hawaii State Bar Association.
