Convene a task force to examine creation and regulation of homeowners associations for pre-statehood subdivisions that lack covenants or declarations for common area maintenance and operations.

Task force membership includes one House member (co-chair), one Senate member (co-chair), Director of Commerce and Consumer Affairs, representatives from Hawaii Council of Community Associations, Community Associations Institute Hawaii Chapter, National Association of Parliamentarians, an association management company, and two representatives from pre-statehood subdivisions.

Examine regulatory framework for entities managing common areas in pre-statehood subdivisions and whether to regulate these entities under Chapter 421J (planned community associations law).

Task force members serve without compensation and must submit findings, recommendations, and proposed legislation to the Legislature no later than 20 days before the 2021 Regular Session convenes.

Address the lack of governmental oversight and standardized procedures for pre-statehood subdivisions that currently collect hundreds of thousands to millions in annual dues with no regulatory guidance, as exemplified by court cases like Paradise Hui Hanalike v. Hawaiian Paradise Park Corporation.
