House Resolution 40 Summary

• Director of Labor and Industrial Relations is requested to convene a working group to explore paid family leave for executive departments reporting directly to the Governor as a potential pilot program.

• Working group must report on the relationship between Hawaii's Temporary Disability Insurance Law, federal Family and Medical Leave Act, and Hawaii Family Leave Law, and identify implementation issues for a paid family leave pilot project.

• Working group must assess fiscal and administrative impacts on the State, effects on public sector collective bargaining and civil service law, and opportunities for scaling the pilot to all Hawaii's workforce.

• Working group composition includes 12 members: seven state executive officials (Labor, Human Resources, Finance, Attorney General, Human Services, Comptroller, and Collective Bargaining representatives) plus five appointed representatives from retiree, children's advocacy, women's advocacy, and public sector labor organizations.

• Working group must submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the 2021 Regular Session convenes.
