Convenes a task force to examine creation and regulation of homeowners associations for pre-statehood subdivisions that lack recorded covenants or declarations governing maintenance of common areas like private roads and infrastructure.

Task force membership includes one House member and one Senate member (serving as co-chairs), Director of Commerce and Consumer Affairs, representatives from Hawaii Council of Community Associations, Community Associations Institute Hawaii Chapter, National Association of Parliamentarians, association management companies, and two representatives from pre-statehood subdivisions.

Task force shall examine framework for regulatory oversight of entities managing common areas in pre-statehood subdivisions, whether to regulate these entities under Chapter 421J (planned community associations law), and other relevant regulatory issues.

Task force members serve without compensation and must submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the 2021 Regular Session convenes.

Certified copies of the resolution shall be transmitted to the Director of Commerce and Consumer Affairs and presidents of relevant community association organizations.
