Makes confidentiality clauses in employment contracts unenforceable regarding sexual harassment claims, except as provided by federal law, while allowing parties to voluntarily enter confidentiality agreements as part of legal settlements.

Prohibits mandatory arbitration agreements from requiring arbitration of sexual harassment claims, effective July 1, 2019, except as otherwise provided by federal law.

Makes mandatory confidentiality clauses within arbitration agreements unenforceable as to sexual harassment claims, while permitting voluntary confidentiality agreements as part of legal settlements of specific claims.

Amends Hawaii Revised Statutes Chapter 658A-6 to establish exceptions for sexual harassment claims in agreements to arbitrate and confidentiality provisions.

Effective date of January 1, 2050.
