S.B. 1082 Summary

• General contractors with direct contracts for private construction work (excluding public works under chapter 104) are liable for unpaid wages owed by subcontractors at any tier to workers performing labor on the project.

• General contractor liability is limited to unpaid wages and interest only; does not extend to penalties, liquidated damages, or fringe benefits.

• The director of labor or joint labor-management cooperation committees may enforce the liability; committees must provide written notice within 90 days of last labor performed or 45 days after completion, whichever is earlier.

• Subcontractors must provide payroll records and project award information to general contractors upon request; general contractors may withhold payment to subcontractors who fail to comply.

• Actions to enforce liability must be filed within one year after actual completion of work; prevailing parties in court actions are awarded reasonable attorney's fees and costs.
