S.B. 1257 Summary

• Amends Hawaii Revised Statutes Section 200-10 to revise moorage and use permit fees for state small boat harbors managed by the Department of Land and Natural Resources.

• Eliminates the two-tiered moorage fee schedule (Schedule A for existing permittees and Schedule B for new applicants) and establishes that all moorage fees shall be determined by appraisal by a state-licensed appraiser at fair market value.

• Removes the requirement that moorage fees be higher for nonresidents than residents and eliminates the minimum $100 application fee requirement for nonresidents.

• Changes the liveaboard fee increase cap from five percent annually to fifty percent annually and establishes that commercial vessel fees shall be the greater of three percent of gross revenues or two times the recreational vessel moorage fee.

• Adds requirement that if a commercial vessel is also used as a place of principal habitation, the permittee must pay an additional liveaboard fee established by appraisal at fair market value.
