SB 1289 Summary

• Prohibits building permits for new single-family dwellings in developments of 20 or more units without rooftop solar energy generation systems beginning January 1, 2022, unless a variance is approved or exemption applies.

• Allows variance exemptions if a licensed architect or engineer attests that solar installation is impracticable due to poor solar resource, cost-prohibitive based on 20-year life cycle analysis, or if an alternative rooftop photovoltaic system is substituted.

• Exempts dwellings affordable to households earning 100% or less of area median income as determined by the U.S. Department of Housing and Urban Development.

• Requires rooftop solar systems to have minimum 5 kilowatts generating capacity and include an energy storage device such as a battery.

• Takes effect July 1, 2050.
