Adds new section to Hawaii Revised Statutes Chapter 804 establishing the right to a prompt bail hearing upon formal charge and detention when either party requests one.

Requires judges to consider four specific factors at bail hearings: whether defendant will flee, obstruct justice or intimidate witnesses/jurors, pose danger to persons or community, or engage in criminal activity.

Guarantees defendants the right to counsel at bail hearings, with appointed counsel if financially unable to afford representation.

Grants defendants the right to testify, present witnesses, cross-examine opposing witnesses, and present information; standard rules of evidence do not apply to bail hearings.

Takes effect on March 15, 2094.
