S.B. 2139 Summary

• Allows candidates to withdraw to fill state legislative vacancies no later than the seventy-fifth day before the next general election, expanding the withdrawal window beyond the current fifty-day limit.

• Modifies the candidate filing deadline for state senate vacancies occurring no later than the tenth day before the close of filing for the primary election, requiring all candidates to file nomination papers by the primary election filing deadline specified in section 12-6.

• Changes the filing deadline for party and nonpartisan candidates attempting to fill vacant state senate seats from the fortieth day before the general election to the seventy-fifth day before the general election.

• Extends the window for filling vacant state senate seats through election from the fiftieth day before the general election to the ninety-fifth day before the general election.

• Takes effect retroactively to June 17, 2020.
