SB2185 Summary

• Adds violations of privacy in the first degree and certain violations of privacy in the second degree (under HRS 711-1111(1)(d)-(h)) to the list of offenses ineligible for deferred acceptance of guilty plea or nolo contendere plea.

• Prohibits government use of facial recognition systems except for: law enforcement comparing surveillance photos to arrest booking photos, driver's license/REAL ID Act compliance, and state airport use with thermal scanning to identify individuals potentially infected with communicable diseases.

• Requires destruction of any facial recognition data obtained at airports within 60 minutes of collection.

• Specifies that facial recognition information cannot constitute probable cause for arrest.

• Takes effect upon approval.
