S.B. 2214 Summary

• Adds new section to Chapter 201H requiring state and county agencies to issue discretionary permits for high-density housing projects within 60 days of receiving a complete application.

• Allows developers to obtain discretionary permits instead of conditional use permits if projects meet six planning standards including: high density (250+ units per acre), location in transit-oriented development zones, affordability at or below 100% area median income, and no demolition of historic properties.

• Prohibits state and county agencies from imposing non-code-related conditions or exactions on projects processed under this section; agencies must provide written documentation within 30 days if an application conflicts with planning standards or the application is deemed compliant.

• Requires counties to issue discretionary permits for high-density housing projects within 60 days of receipt of complete application and amends Section 46-15.1 to clarify county housing development powers.

• Effective July 1, 2050, with amendments to Section 46-15.1 preserved when that section is reenacted in 2024.
