Lowers the legal blood alcohol concentration (BAC) threshold for operating a vehicle under the influence from .08 to .05 grams per 100 milliliters of blood or per 210 liters of breath.

Changes the "measurable amount of alcohol" definition from .08 to .05 grams per 100 milliliters of blood or per 210 liters of breath, establishing a new intermediate category between .02 and .05.

Modifies presumptions in criminal prosecutions so that BAC of .02 or less creates a presumption of not being under the influence, while .02 to .05 may be considered with other evidence but creates no presumption.

Applies the new .05 threshold to sections 291E-61 (operating a vehicle under the influence) and 291E-61.5 (habitual operation under the influence), as well as to administrative license revocation procedures.

Takes effect upon approval; does not affect rights, duties, penalties, or proceedings that began before the effective date.
