S.B. 2354 - Truth in Music Advertising Act

• Establishes the Truth in Music Advertising Act to prohibit false, deceptive, or misleading claims of affiliation between performing groups and recording groups in live musical performances within Hawaii.

• Exempts performances from the prohibition if the performing group owns a federal service mark for the recording group, includes an original member with legal rights to the name, is clearly labeled as a tribute, or has express authorization from the recording group.

• Treats violations as unfair or deceptive acts under Hawaii consumer protection law, allowing the attorney general to seek injunctive relief and courts to order restoration of money or property obtained through violations.

• Provides private right of action for injured parties, including assignees and licensees, to recover treble damages, reasonable attorney's fees, filing fees, and costs.

• Takes effect upon approval.
