S.B. 2381 Summary

• Increases minimum shoreline setback requirement from 20 feet to 40 feet inland from the shoreline for all structures in Hawaii.

• Adds new requirement that structures maintain an altitude of at least two meters above the shoreline.

• Changes the grandfather date for structures exempt from shoreline setback variance requirements from June 16, 1989 to January 1, 2020.

• Department of Land and Natural Resources must adopt and enforce rules implementing the new shoreline setback requirements.

• Effective date is December 31, 2033.
