Authorizes the mental health and substance abuse special fund to be used for capital improvements, defined as acquisition of real property, improvements to expand capacity of existing public facilities, and development of new public facilities.

Requires the Department of Health to identify capital improvement projects funded by the special fund to improve behavioral health services, including crisis stabilization beds and supported transition units.

Requires the Department of Health to determine project costs and investigate whether private nonprofit organizations could operate state facilities with underutilized bed space, supplemented by fundraising and non-state funds.

Requires the Department of Health to submit findings, recommendations, and any proposed legislation to the legislature no later than twenty days before the 2021 regular session convenes.

Effective July 1, 2050, with automatic repeal on June 30, 2025, restoring prior law regarding the special fund.
