SB2539 Summary

• Requires all health insurers, mutual benefit societies, and health maintenance organizations in Hawaii to provide comprehensive coverage for reproductive health services without cost-sharing, including abortion, contraception, family planning, and related preventive care services as of January 2, 2021.

• Mandates coverage of specific preventive services for women including well-woman visits, sexually transmitted infection counseling and screening, gestational diabetes screening, breastfeeding support, and voluntary sterilization with associated counseling and services.

• Prohibits discrimination in reproductive health care coverage based on race, color, national origin, sex, gender identity, sexual orientation, age, or disability, with violations treated as violations under Chapter 489.

• Eliminates prior authorization, step therapy, and other utilization controls for covered contraceptive supplies, and requires coverage for contraceptive supplies intended to last up to 12 months, including over-the-counter products.

• Applies to all individual and group health insurance policies, contracts, and agreements issued or renewed on or after January 2, 2021, with exemptions available only if enforcement would adversely affect federal funding allocation.
