S.B. 2673 Summary

• Prohibits postsecondary educational institutions from preventing student athletes in intercollegiate athletics from earning compensation for use of their name, image, or likeness, with earnings not affecting scholarship eligibility.

• Prevents athletic associations, conferences, and other organizations from blocking student athletes from receiving name, image, and likeness compensation or preventing institutions from participating in athletics based on such compensation.

• Allows student athletes to obtain professional legal representation for contracts and name, image, likeness matters, while prohibiting compensation offers to prospective student athletes for these purposes.

• Requires student athletes to disclose name, image, and likeness contracts to institutional officials and prevents team contracts from restricting commercial use of student names, images, or likenesses outside official team activities.

• Classifies violations as unfair or deceptive practices under Hawaii consumer protection law; takes effect June 18, 2050.
