• Prohibits retailers from selling, offering for sale, or possessing with intent to sell flavored tobacco products, including those with menthol, effective January 1, 2021.

• Prohibits mislabeling or marketing e-liquid products containing nicotine as nicotine-free.

• Defines "flavored tobacco product" as any tobacco product containing a constituent that imparts a characterizing flavor, including candy, chocolate, fruit, menthol, mint, and similar tastes or aromas.

• Imposes fines up to $500 for first violations and $500-$2,000 for subsequent violations; confiscated products are destroyed as contraband.

• Permits counties to adopt more restrictive rules or ordinances, with the more stringent restrictions prevailing in case of conflict.
