SB 3103 Summary

• Establishes the school facilities agency as a public instrumentality within the Department of Education responsible for all public school development, planning, and construction related to capital improvement projects.

• Creates a five-member school facilities board appointed by the governor to advise the agency on policies and evaluate the executive director annually; board members must have an interest in school facilities with at least one representing the construction industry.

• Designates a governor-appointed executive director, exempt from civil service and term limitations, to serve as chief executive officer for a six-year term subject to senate confirmation.

• Establishes a school facilities special fund to receive appropriations for capital improvement projects, school impact fees, grants, and donations, to be administered by the agency for school development and construction projects.

• Transfers management of capital improvement projects authorized by Acts 155 (2013), 115 (2015), 206 (2017), 210 (2018), and 272 (2019) to the new agency and repeals the state educational facilities improvement special fund.
