SB 3152 Summary

• Defines "cultural assessment" as a written evaluation by a qualified ethnographer to determine whether an action may significantly affect cultural practices, particularly Native Hawaiian traditional and customary practices protected under the state constitution.

• Defines "cultural impact assessment" as an ethnographic study prepared by a qualified ethnographer that discloses cultural effects of a proposed action, including proposed mitigation measures and alternatives.

• Requires cultural assessments to be included with and made available for public review alongside draft environmental assessments for a 30-day period.

• Requires a cultural impact assessment to be prepared if an agency determines a proposed action may have a significant effect on the environment.

• Takes effect July 1, 2050.
