HI SB641

Establishes new criminal offense of operating a vehicle while impaired by a lesser intoxicant, defined as substances not included in alcohol or controlled substance schedules I-IV (includes kava, certain muscle relaxants, synthetic drugs, and other intoxicants).

Penalties for violation are a petty misdemeanor with a fine not exceeding $1,000 or imprisonment not exceeding 30 days, or both.

Requires law enforcement agencies to collect and annually report data on investigations, arrests, blood/urine tests, test results, and types of lesser intoxicants detected.

Requires the Criminal Justice Data Center to collect and annually report the number of convictions for this offense to the legislature.

Effective July 1, 2050, with automatic repeal on June 30, 2022.
