SB824 Summary

• Requires moped and motor scooter rental companies to provide safety helmets to riders and ensure helmets are worn before operation, unless the rider provides their own helmet.

• Exempts riders who possess a valid motorcycle license or equivalent license from another state from the mandatory helmet requirement for rented mopeds and motor scooters.

• Prohibits rental companies from renting any moped or motor scooter that has aftermarket modifications to the motor that exceed two horsepower (1,492 watts) or do not comply with manufacturer specifications.

• Amends helmet requirements for moped operators under age 18 to require safety helmets securely fastened with a chin strap, and maintains the prohibition on moped operation for persons under age 15.

• Takes effect on July 1, 2050.
