S.B. 840 Summary

• Allow the elections commission to refer complaints to the attorney general or county prosecutor in addition to administrative determinations, without requiring belief that the respondent recklessly, knowingly, or intentionally committed a violation.

• Increase the disqualification period from elective public office for persons convicted of violating election criminal prosecution laws from four years to ten years from the date of conviction.

• Repeal the exemption that prevented criminal prosecution of persons who paid or agreed to pay fines for report filing violations and advertisement violations prior to commencement of proceedings.

• Clarify that subsection (g) of Section 11-410 still applies to fines even though the criminal prosecution exemption is removed.
