S.B. 934 Summary

• Prohibits waste or disposal facilities from being located in conservation districts except in emergency circumstances to mitigate significant risks to public safety and health.

• Defines "emergency" as any natural or man-made occurrence, or imminent threat, resulting in or likely to result in substantial injury, harm to the population, or substantial damage to or loss of property.

• Defines "waste or disposal facility" to include transfer stations, landfills, open dumps, solid waste reduction facilities, and any other facility for solid waste disposal requiring a permit from the department of health.

• Limits any emergency authorization for waste or disposal facilities in conservation districts to a maximum of three years.

• Effective date: July 1, 2050.
