S.B. 975 Summary

• Requires owners of agricultural or preservation land subdivided as condominium property regimes in counties with populations of 750,000 or more to provide public notice of sale within 90 days of the sale

• Prohibits any residential use of storage sheds and other structures on subdivided agricultural lands, with violations subject to county enforcement and fines

• Establishes county enforcement authority for violations of agricultural land subdivision requirements in counties with 750,000+ population, with 30-day investigation periods and annual reporting to the Department of Agriculture

• Permits counties with 750,000+ population to adopt ordinances (in addition to rules) governing condominium property regimes and to review infrastructure and environmental impacts in condominium project approvals on agricultural land

• Requires developer public reports for condominium projects on agricultural land to certify compliance with section 205-4.5(f), which governs subdivisions and leasing on agricultural lands
