S.C.R. No. 240 Summary

• Requests the Developmental Disabilities Division of the Department of Health to revise eligibility criteria for the Home and Community-Based Services Medicaid Waiver (I/DD Waiver) to include individuals with intellectual or developmental disabilities, or mental illnesses.

• Current administrative rules deny waiver eligibility to individuals whose primary impairments stem from dementia, mental illness, emotional disorders, substance abuse, sensory impairment, learning disabilities, ADHD, spinal cord injuries, or neuromuscular disorders.

• Directs the Department of Health to change rules that unfairly exclude individuals who have both an ineligible condition and an eligible condition such as cerebral palsy, epilepsy, autism spectrum disorder, or certain neurological or chromosomal disorders.

• Requires the Director of Health to submit a status report on new eligibility criteria development, including any proposed legislation, to the Legislature no later than twenty days before the 2021 Regular Session convenes.

• Directs certified copies be transmitted to the Director of Health, Developmental Disabilities Division Administrator, Director of Human Services, and Med-QUEST Division Administrator.
