HB 1022 Summary

• Authorizes conservation and resources enforcement officers to stop and temporarily detain any person reasonably believed to be engaged in or recently engaged in hunting or fishing to inspect licenses, permits, and wildlife/aquatic resources in their possession.

• Permits officers to inspect game or aquatic life, containers that could reasonably carry such resources, and equipment used for taking wildlife, while reasonably proximate to the hunting or fishing area, without requiring probable cause.

• Prohibits officers from inspecting clothing on the person or containers that could not reasonably carry game or aquatic life unless there is probable cause or incident to arrest.

• Establishes administrative fines for violations: up to $1,000 for first violation, up to $2,000 for second violation within five years, and up to $3,000 for third or subsequent violations within five years.

• Inspections must be conducted within reasonable distance from where the hunting or fishing took place, with vehicular inspections limited unless probable cause exists or the person fails to stop when requested.
