HB 1090 Summary

• Raises the age threshold for child passenger restraint requirements from under eight years to less than ten years of age.

• Requires rear-facing child safety seats for children less than two years of age, and rear-facing or forward-facing seats with internal harnesses for children ages two to four years.

• Allows children ages seven to ten years to use a lap and shoulder seat belt assembly instead of a booster seat if they are over four feet nine inches in height.

• Removes the prior exemption for vehicle overcrowding and eliminates the exception allowing unrestrained children in back seats when seat belt assemblies are unavailable.

• Effective date: July 1, 2050.
