HB 1218 Summary

• Prohibits planned community associations (Chapter 421J) and condominium associations (Chapter 514B) from preventing unit owners from establishing home-based businesses on their premises.

• Voids any association documents, leases, or contracts that ban or prevent home-based businesses.

• Allows associations to adopt reasonable bylaws or rules regulating home-based businesses, provided they do not prohibit them entirely.

• Restricts home-based business operations if they unduly require common areas/elements, create undue burden on neighbors through traffic or parking impacts, or violate federal, state, or county hazardous materials laws.

• Defines "home-based business" as any enterprise whose primary office is located in the owner's personal residence; effective July 1, 2050.
