H.B. 1231 Summary

• Adds a third gender marker option "X" to Hawaii birth certificates, allowing individuals to designate their sex as male, female, or X (non-binary).

• Adults (18 years or older, or emancipated minors) may apply to change their own sex designation on birth certificates by submitting a notarized application with required identifying information.

• Parents or legal guardians of minors may apply to change a minor's sex designation with submission of a signed statement from a licensed health care provider confirming the minor is under their care and the request is consistent with the minor's identity.

• Required application information includes full name, date of birth, place of birth, both parents' names, contact information, and requested sex designation.

• The Department of Health must create and make available necessary forms for all birth certificate amendment categories, effective July 1, 2021; remaining provisions take effect January 1, 2022.
