HB 1240 Summary

• Authorizes courts to order forfeiture of retirement system benefits (interest, pension, annuity, or retirement allowance) for law enforcement officers convicted of employment-related felonies, with proceeds used to pay or reimburse the State or county for defense costs.

• Requires any law enforcement officer under investigation for a felony offense to be immediately placed on unpaid administrative leave pending the investigation.

• Permanently bars law enforcement officers convicted of any felony offense from future employment as a law enforcement officer, private detective, or guard, and revokes any existing licenses or certifications.

• Defines "employment-related crime" to include crimes where the officer uses official position, commits the crime using State/county resources, bribery, embezzlement of public funds, or crimes against persons in the officer's custody or supervision.

• Applies prospectively only to crimes committed after the effective date and does not affect benefits accrued before the Act's effective date.
