• Amends Chapter 328G to regulate hemp processing and hemp product manufacturing separately, establishing registration requirements through the Department of Health for both activities.

• Requires hemp processors to obtain a USDA license and register with the state; allows manufacturers to process hemp into hemp products intended for oral consumption (tablets, capsules, powders, softgels, gels, gummies, liquids) or topical application.

• Prohibits sale of hemp products as food additives, synthetic cannabinoids, products for smoking/inhalation, and products for non-oral routes of entry (eyes, ears, nasal); restricts sales to persons 21 years and older.

• Establishes labeling requirements including product name, ingredients, manufacturer information, and FDA disclaimer; requires testing for THC concentration (not exceeding 0.3%) and contaminants per department rules.

• Repeals the sunset date of Act 14 (Session Laws of Hawaii 2020) to make hemp cultivation and processing permanent in the State.
