H.B. 1316 Summary

• Department of Health must conduct a study on benefits and costs of implementing extended producer responsibility in Hawaii, with findings and recommendations due to legislature no later than 20 days before the 2024 regular session.

• Beginning January 1, 2022, full-service restaurants are prohibited from providing single-use plastic service ware (straws, stirrers, utensils) unless requested by consumers; first two violations receive notices, subsequent violations subject to fines up to $25 per day (maximum $300 per calendar year).

• Beginning January 1, 2023, beverage manufacturers selling plastic beverage containers in Hawaii must meet minimum postconsumer recycled content requirements: 15% by December 31, 2025; 25% by December 31, 2030; and 50% on and after January 1, 2031.

• Department of Health authorized to adopt rules regarding postconsumer recycled content percentage adjustments, manufacturer reporting requirements, and enforcement penalties.

• Bill effective July 1, 2050.
