H.B. 1385 Summary

• Implements recommendations from the 2020 procurement policy review conducted pursuant to House Resolution No. 142 (2016) that compared Hawaii's procurement process to the federal government's process.

• Requires the state procurement office to establish a past performance database for state contractors, including contractor name, project dates, scope, budget information, timeliness of completion, and cost variances.

• Allows past performance on state contracts to be considered as an evaluation criterion in competitive sealed bidding for goods and services, and in requests for proposals.

• Permits the head of a purchasing agency to negotiate construction bid prices when the lowest responsive and responsible bid significantly differs from the State's pre-bid project estimate, including reducing or increasing the bid amount to align with the estimate.

• Requires the state procurement office to report to the legislature by December 2021 on progress implementing the procurement policy review recommendations and any proposed legislation needed.
