HB 307 Summary

• Authorizes condominium associations and planned community associations to conduct electronic meetings and electronic or machine voting during any declared state of emergency or local state of emergency, regardless of what their governing documents provide.

• Amends Chapter 421J, Hawaii Revised Statutes, to require that association documents be deemed to authorize electronic meetings and electronic or machine voting during periods when a state of emergency or local state of emergency is in effect under Chapter 127A.

• Modifies Section 514B-121 to explicitly allow condominium association meetings to be conducted by electronic means during a state of emergency or local state of emergency, overriding any conflicting provisions in the declaration or bylaws.

• Modifies Section 514B-125 to allow condominium boards to conduct meetings remotely during a state of emergency or local state of emergency, regardless of what the declaration or bylaws provide.

• Takes effect upon approval.
