Requires assessment of patients admitted to emergency departments or hospitalized on an emergency basis who are diagnosed with mental illness or severe substance use disorder and found to lack decisional capacity to determine if a surrogate or guardian should be appointed.

Applies to patients evaluated by psychiatrists or advanced practice registered nurses with prescriptive authority and psychiatric specialization who are deemed mentally ill, imminently dangerous to self or others, and in need of care or treatment.

Clarifies language regarding emergency examination procedures and patient notification rights, including the right to contact a guardian, family member, reciprocal beneficiary, or attorney immediately upon admission.

Takes effect on July 1, 2060.
