H.B. 330 - Healthy Ohana Act of 2021

• Imposes a two-cent-per-fluid-ounce fee on sugar-sweetened beverages sold by distributors in Hawaii, effective June 30, 2022, to be passed through to consumers at retail.

• Establishes the Healthy Ohana Special Fund to receive all fee revenues, with distributions allocated for obesity prevention, oral health promotion, chronic disease prevention programs, and a separate trust fund for long-term health initiatives.

• Creates a Healthy Ohana Trust Fund administered by a nonprofit 501(c)(3) organization to support obesity and chronic disease prevention programs, farm-to-school initiatives, school gardens, and nutrition education.

• Requires distributor registration with the Department of Health, establishes record-keeping and audit requirements, and imposes civil penalties including 50 percent penalty on unpaid fees plus interest at 8 percent annually.

• Appropriates $250,000 for each of fiscal years 2021-2022 and 2022-2023 to establish and implement the program; Department of Health must repay general fund from fee revenues by July 1, 2023.
