H.B. 357 Summary

• Establishes a two-year statute of limitations for inverse condemnation claims brought against the State under article I, section 20 of the Hawaii State Constitution

• Amends section 661-1, Hawaii Revised Statutes, to expressly include claims against the State founded on article I, section 20 of the Hawaii State Constitution within the jurisdiction of state circuit and district courts

• Responds to the Hawaii Supreme Court's decision in DW Aina Le'a Dev., LLC v. State Land Use Comm'n, 148 Haw. 396 (2020), by providing statutory certainty regarding the timeframe for filing such claims

• Does not apply retroactively to rights, duties, penalties, or proceedings that matured or began before the Act's effective date
