HB 386 Summary

• Requires drug manufacturers selling drugs in Hawaii to establish and implement drug take-back programs or join existing programs for collection and disposal of covered drugs by July 1, 2022.

• Creates a new chapter establishing comprehensive requirements for drug take-back programs, including collection system standards, disposal methods, public education, funding mechanisms, and annual reporting.

• Covered drugs include legend drugs, nonlegend drugs, veterinary drugs, and drugs in medical devices, but exclude vitamins, Schedule I controlled substances, cosmetics, and drugs with manufacturer-provided take-back programs.

• Programs must provide multiple collection methods including retail pharmacy and law enforcement collection sites, mail-back programs, and periodic collection events, with each county having a minimum of one collection site.

• Establishes enforcement authority for the Department of Public Safety with penalties up to $2,000 per violation, allows audits and inspections of programs, and requires program operators to submit annual reports on collection amounts and program implementation.
