H.B. 391 Summary

• Allows servicemember tenants on orders to vacate civilian housing and move into on-post government quarters to terminate rental agreements of one year or less without penalty, fees, or liability for future rent, provided they request 30 days written notice and submit military orders or commanding officer verification.

• Permits month-to-month servicemember tenants to terminate rental agreements under the same conditions with only 15 days written notice.

• Authorizes adult family members to terminate rental agreements on behalf of deceased servicemembers on active duty by submitting 15 days written notice, a death certificate, and proof of active duty status.

• Allows landlords to withhold prorated security deposits only for damages caused by tenant noncompliance and prohibits assessment of any fees or penalties against terminating servicemembers or their family members.

• Effective November 1, 2021; does not apply to military orders resulting from disciplinary action or court order and does not affect rights under the federal Servicemembers Civil Relief Act.
