H.B. 398 Summary

• Clarifies that the Department of Public Safety retains custody and jurisdiction over Hawaii inmates transferred to out-of-state correctional institutions.

• Authorizes the Department of Public Safety to transport Hawaii inmates back to the State at any time and for any reason.

• Requires Hawaii inmates incarcerated at out-of-state facilities to be afforded all rights and privileges available to inmates in Hawaii facilities, whether established by law, rule, department policy, or other authority.

• Addresses concerns about constitutional rights violations at private out-of-state prisons, including intercepted attorney-client communications and violence against inmates.

• Effective July 1, 3050.
