Defines "past performance" as available recent and relevant performance of a contractor, including positive, negative, or lack of previous experience, to be considered in responsibility determinations for procurements.

Requires the state procurement office to establish and administer a past performance database by December 31, 2023, containing contractor information including project dates, sizes, descriptions, timely completion status, authorized budgets, and cost variances.

Mandates the state procurement office adopt rules by December 31, 2023, establishing procedures for informing contractors of database information about them and procedures for contractors to correct or respond to information.

Requires procurement officers to consider past performance as an evaluation factor in competitive bids, requests for proposals, and design-build projects, with past performance evaluations to be maintained in procurement files and the statewide database for procurements over the small purchase threshold.

Amends the definition of "responsible bidder or offeror" to include consideration of past performance and requires past performance reviews for non-competitive contract awards.
