H.B. 686 Summary

• Amends Hawaii Revised Statutes Section 708-811 to expand the burglary in the second degree offense to include unlawfully entering or remaining on critical electrical infrastructure.

• Defines "critical electrical infrastructure" as areas integral to the operation of power plants, electric transmission facilities, electric stations or substations, and other facilities supporting generation, transmission, or distribution of electricity.

• Requires critical electrical infrastructure to be fenced or enclosed with posted warning signs stating "Private Property – Critical Electrical Infrastructure (HRS §708-800) – No Trespassing" with letters at least two inches high, placed at intervals of no less than three signs per mile along boundary lines.

• Establishes that persons must recklessly disregard a substantial and unjustifiable risk that the property is critical electrical infrastructure while intending to commit a crime against a person or property rights to violate this offense.

• Maintains burglary in the second degree as a class C felony and takes effect upon approval.
