HB 760 Summary

• Expands the works of art special fund (created under Hawaii Revised Statutes section 103-8.5) to support performing arts in addition to visual arts in public places and the state art museum.

• Defines "performing arts" to include dance, choreography, singing, lyrics, motion pictures, music, theater, pantomime, screenplays, sound recordings, and similar works intended for audience performance.

• Allows performing arts to be funded through the works of art special fund only when the performance is recorded (as audio, video, or audiovisual file) and archived by the foundation or state art museum as state property with exclusive copyright held by the State.

• Permits display of recorded performances at public presentation sites determined by the comptroller and foundation to be most accessible to the public.

• Effective date: July 1, 2065.
